Article 1 – Definitions.
In these General Terms and Conditions, the following terms shall have the following meanings:
• “the Work of Art”: the work specified in the agreement between the Artist and the Client.
• “the Artist”: the creator of the Artwork.
• “the Client”: the natural person or legal entity entering into an agreement with Oscar van Geesbergen.
Article 2 – Applicability of the General Terms and Conditions.
These General Terms and Conditions apply to all agreements, commissions, offers and quotations entered into with or issued by Oscar van Geesbergen Art.
Article 3 – Formation of the Agreement.
The agreement between Rick Triest and the Client is formed upon the Client’s acceptance of the offer made by Oscar van Geesbergen Art.

Article 4 – Prices.
• All prices are in euros and include VAT.
• Price changes resulting from legislation, such as those relating to VAT, may be passed on to the Customer.
Article 5 – Purchase of a Work of Art.
• Where the agreement concerns the purchase of a Work of Art, the agreement to be drawn up shall set out the
details of the Work of Art, the Customer’s details, the method of payment, the method of delivery and any other relevant details.
• The Artwork shall be delivered to the Customer within one month of the end of the Exhibition, unless otherwise agreed.
If the Artwork is in stock and is not being or will not be exhibited, delivery may take place earlier or directly at exhibitions.
• Any specified delivery time is always indicative, unless expressly agreed otherwise.
• Delivery of the Artwork shall take place in the manner agreed in the contract.
The Artwork shall be at the Customer’srisk from the time of delivery.
• Complaints regarding defects in the purchased Artwork must be submitted in good time after such defects are
discovered, whereby within one month shall in any event be deemed timely. Failure to complain in good time shall
result in the loss of rights.
Article 6 – Repairs and other work.
• Repairs and other work carried out by Oscar Van Geesbergen Art on a Work of Art owned by the Client shall always be performed on a best-efforts basis.
• Upon delivery of the Artwork, the Client is obliged to inspect the work carried out. If the Client finds the work carried out to be unsatisfactory, they must notify the Artist immediately, preferably in writing.
• The Customer shall be deemed to have accepted the work carried out if they have not reported any defects in the work carried out within one month of delivery of the Artwork.
Article 7 – Payment.
• Payment by the Customer shall be made:
• In cash, including debit card and credit card payments;
• On the basis of an invoice.
• If an invoice is sent, the payment term is 14 days from the invoice date. Upon the mere expiry of this term,
the Customer shall be in default and shall owe statutory interest from the date on which the default commenced.
• Any reasonable extrajudicial costs incurred by Oscar Van Geesbergen Art shall be borne by the Customer.
Article 8 – Retention of title and right of retention.
• Until the Customer has paid the full purchase price, including any additional costs, Oscar Van Geesbergen Art retains title to the Artwork.
In that case, title shall pass to the Customer as soon as the Customer has fulfilled all their obligations.
Article 9 – Data Protection Act.
• Oscar van Geesbergen Art will process the Customer’s personal data and store it in a database. The purpose of processing the personal data is to enable Oscar van Geesbergen Art to fulfil the agreement entered into with the Customer, as well as to keep the Customer informed about Oscar van Geesbergen Art and the activities it undertakes.
• The Customer may at any time contact Oscar van Geesbergen Art to request information as to whether, and if so, which personal data concerning him/her is being processed. If the Customer considers that the personal data should be corrected, supplemented, deleted or restricted, the Customer must notify Oscar van Geesbergen Art of this in writing or electronically.
Article 10 – Intellectual property.
• The copyright in the Artwork remains vested in Oscar van Geesbergen Art. This right of Oscar van Geesbergen Art
imposes restrictions on the Customer regarding the use, disclosure and reproduction of the Artwork.
Article 11 – Governing law and disputes.
• The agreement and any other legal relationships between the Customer and Oscar van Geesbergen Art are governed by Dutch law.
• All disputes arising from the agreement(s) and these General Terms and Conditions shall be submitted to the competent court.
